FF CALLS FOR RELEASE OF FR NIALL MOLLOY REPORT

Fr. Niall Molloy - Unsolved Murder 1985

FF CALLS FOR RELEASE OF FR NIALL MOLLOY REPORT

Fianna Fáil Justice Spokesperson Niall Collins TD has called on the Justice Minister Frances Fitzgerald to release the report she commissioned from Mr Dominic McGinn SC following his examination of the report of the Serious Crime Review Team into the Fr Niall Molloy murder.

Confirmation that the Minister has received a copy of the report came following a Parliamentary Question tabled by the Fianna Fáil representative.

Deputy Collins commented, “I welcome the fact that Mr McGinn has concluded his work and would call now on the Minister to brief Fr Molloy’s family and then publish his findings.  In her answer to my question, the Minister said that she was considering the report in consultation with the Attorney General.  While it is understandable that she will want to take advice on whatever has emerged from Mr…

Negligence claims against gardaí concerning criminal investigations to proceed to trial Smyth vs Commissioner of An Garda Síochána (2014) IEHC 453 (High Court, Peart J, July 10th, 2014)

The High Court refuses to strike out negligence claims against the Garda for alleged negligence in criminal investigations in the 1980s and 1990s, on grounds that it was not inevitable that the claims would fail, where the plaintiffs claimed a special relationship with the Garda that gave rise to a duty of care.
